WHAT SERVICES SHOULD I EXPECT AS PART OF MY BANKRUPTCY?
As part of Attorney Donovan’s bankruptcy services he will meet with each client to determine whether bankruptcy is right for them, and if bankruptcy is appropriate, he will help the client determine which bankruptcy chapter to file under. Once the decision has made to file for bankruptcy, Attorney Donovan will inform the client of the various financial information that must be provided to complete your bankruptcy petition. As is true with most things in life, it takes some work to achieve the desired result, and the same is true of bankruptcy. It requires participation and work by each client, but with the assistance of Attorney Donovan, the process will be much smoother and common pitfalls avoided. After your financial information is provided to Mr. Donovan, he will prepare and file your bankruptcy petition. Once the petition is filed, you will be notified of a date for the 341 Meeting of the Creditors. Despite its name, creditors generally do not appear at such meetings. Generally, just the trustee for your case will be present to ask you questions about your assets. In a Chapter 7 no-asset bankruptcy case, this is generally all that is required of you before receiving your discharge. In a Chapter 7 asset case, you would be required to cooperate with the trustee and turnover any non-exempt assets. If you have filed a Chapter 13 bankruptcy case, you would be required to make regular payments to the Trustee over the term of the plan before you receive a discharge.
